Terms and Conditions for Workshops and Retreats
These terms and conditions apply to all bookings made with Seabournes Studios for workshops, retreats and related events.
By making a booking online, by telephone or by post, you confirm that you have read and agreed to these terms and conditions.
1. Bookings and Payment
1.1 A booking is confirmed only when we have received your deposit payment of £250 and we have confirmed your booking in writing (usually by email).
1.2 The remaining balance must be paid no later than 12 weeks before the start date of the workshop or retreat.
1.3 If full payment is not received by the due date, we may treat the booking as cancelled by you and may offer your place to another participant.
1.4 Prices shown include any applicable taxes unless stated otherwise.
2. Your Right to Cancel
2.1 You may cancel your booking within 14 days of receiving written confirmation of your booking and receive a full refund of all amounts paid, unless the workshop or retreat begins within that 14-day period.
2.2 After the 14-day cancellation period, the following cancellation terms apply:
2.3 If, following your cancellation, we are able to fill your place from a waiting list or replacement booking, we may refund additional sums at our discretion, less any reasonable administrative and unrecoverable costs.
2.4 Refunds will normally be processed within 14 days of agreement.
3. Transfers
3.1 You may request to transfer your booking to another workshop or retreat within the same calendar year, subject to availability.
3.2 Transfer requests made more than 8 weeks before the start date will normally be accommodated without additional charge other than any difference in course fees.
3.3 Transfer requests made less than 8 weeks before the start date may be refused where we are unable to refill your original place.
3.4 A booking may only be transferred once.
4. Cancellation by Seabournes Studios
4.1 We reserve the right to cancel a workshop or retreat where reasonably necessary, including where minimum participant numbers are not met, a tutor becomes unavailable, venue or safety issues arise or events outside our reasonable control prevent the event from taking place.
4.2 If we cancel a workshop or retreat, you may choose either a full refund of all monies paid or transfer to another available workshop or retreat.
4.3 We are not responsible for costs you incur separately from your booking, including travel, accommodation booked elsewhere, insurance or other consequential losses, except where such losses arise directly from our negligence or breach of legal duty.
Nothing in these terms limits any rights you may have under applicable consumer law.
5. Changes to Workshops or Retreats
5.1 We may make reasonable changes to tutors, schedules, accommodation arrangements, workshop content or facilities, where necessary due to circumstances outside our reasonable control or to improve the participant experience.
5.2 Where a significant change materially affects the nature of the workshop or retreat, we will notify you as soon as reasonably possible and offer either a transfer to another event or an appropriate partial refund or full refund where appropriate.
6. Conduct and Safety
6.1 We are committed to providing a safe, respectful and inclusive environment for all participants, tutors and staff.
6.2 We may ask a participant to leave a workshop or retreat where we reasonably believe that the participant has behaved abusively, violently or in a discriminatory manner, poses a risk to the safety or wellbeing of others, seriously disrupts the event or causes significant damage to property.
6.3 Where removal from a workshop or retreat is necessary under this clause, we will act reasonably and proportionately in the circumstances.
6.4 No refund will normally be provided where a participant is asked to leave due to serious misconduct.
6.5 We will make reasonable adjustments for disabled participants where reasonably practicable. Participants are encouraged to discuss access requirements with us before booking.
7. Health and Accessibility
7.1 Participants are responsible for ensuring that the workshop or retreat is suitable for their personal health and mobility requirements.
7.2 If you have specific access, medical, dietary or support requirements, please contact us before booking so we can discuss whether your needs can reasonably be accommodated.
7.3 The studio currently has steps and does not presently provide wheelchair access.
8. Damage to Property
8.1 Participants are responsible for any loss or damage caused by them intentionally or through negligence.
8.2 We may charge participants for the reasonable cost of repair, replacement or additional cleaning arising from such damage.
9. Guests, Smoking and Pets
9.1 Bookings are personal to the named participant and may not be transferred without our prior written agreement.
9.2 Guests or visitors are not permitted on site without prior permission.
9.3 Smoking and vaping are not permitted inside buildings.
9.4 Pets are not permitted unless expressly agreed in advance.
10. Confidentiality and Recording
10.1 Participants should respect the privacy and creative work of other participants and tutors.
10.2 Audio or visual recording of workshops, sessions or participants is not permitted without prior consent from those involved.
10.3 Any personal information shared during workshops should be treated respectfully and not disclosed outside the group without permission, unless required by law.
11. Personal Data
11.1 We collect and process personal data in accordance with applicable UK data protection legislation, including the UK GDPR and the Data Protection Act 2018.
11.2 We use personal information to administer bookings, communicate with participants, accommodate reasonable access or dietary needs and improve our services.
11.3 We do not store payment card details.
11.4 We will only send marketing communications where permitted by law, and you may opt out at any time.

12. Liability
12.1 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence fraud or fraudulent misrepresentation or any liability which cannot legally be excluded.
12.2 Subject to clause 12.1, our total liability arising in connection with any booking shall not exceed the total amount paid by you for the relevant workshop or retreat.
12.3 We are not responsible for loss of personal belongings indirect or consequential losses or events outside our reasonable control except where caused by our negligence or breach of legal duty.
13. Complaints
13.1 If you are dissatisfied with any aspect of your workshop or retreat, please notify us as soon as possible so that we have an opportunity to address the issue.
13.2 Formal complaints should normally be submitted in writing within 28 days of the end of the workshop or retreat.
13.3 Nothing in this clause affects your legal rights.
14. Governing Law
14.1 These terms and conditions are governed by the laws of England and Wales.
14.2 Any disputes arising in connection with these terms shall be subject to the jurisdiction of the courts of England and Wales.
